An autopsy has been scheduled for the newborn baby found in a San Antonio, Texas trash recycling center.
A medical examiner is slated to conduct an autopsy on Tuesday, just one day after the child was found stuffed in a duffel bag at a waste management facility.
San Antonio police are looking to go after a capital murder case, which could result in the death penalty if the suspect is found guilty.
The baby looked to be between one to 10 days old, according to Reuters. Police have not yet publicized the gender of the baby.
"It should never get to a situation where you throw out a child like it was common trash," sergeant with the San Antonio police Daniel Gonzalez told Reuters. "If something happened that you couldn't care for the child, you could take the child to a police station. It shouldn't end like this."
Spokesperson for the company that oversees the recycling center Lisa Doughty explained that the child was first found by an employee who discovered the tiny body on a conveyor belt.
"That is where all of the recyclable material which is placed into the recycle bins by residents and businesses is taken into the plant to be sea parted," Waste Management Inc.'s Doughty stated.
Under "Baby Moses Law" - a piece of legislation that tries to provide despondent parents with a legal option - anyone who leaves an uninjured baby won't be charged for neglect or abandonment, Reuters reported.
