Mindy McCready Admitted to Rehab: Ex Husband Files for Son's Custody

Mindy McCready's father is concerned over her health and filed a petition to move the country singer to a treatment facility to undergo mental health evaluation, says E! News report.

Tim McCready filed the petition seeking to get his daughter treated for her self- destructive behavior.

E! News got access to the petition filed by Tim. "Since boyfriend (David Wilson) shot himself she has been in bed for 3 wks," Tim wrote. "Sleeps all day. Drinks all night and is taking Rx drugs. Not bathing or even helping take care of her 2 children."

McCready's two sons, Zander and Zayne, have been taken away by the Department of Human Services Wednesday. "It was reported to me by DHS that they took custody of the kids this afternoon. They are in DHS custody at this point," Eric Hughes, McCready's attorney said.

A hearing this Wednesday confirmed that McCready was ordered to be committed to a treatment facility for up to 21 days. "Family members sought to have Mindy committed to a mental-health facility and there was an emergency hearing today," a source tells E! News. "They just got out of court a little while ago and the judge committed her for up to 21 days. Mindy needs to get help and we all care and love her and we want her to get the right help so she can move on."

Family believes the death of McCready's boyfriend, David Wilson, has left her in a dark place, source told E! News.

While McCready has been admitted to a treatment facility and sons taken away by DHS, the singer's ex-husband, Billy McKnight, has filed for full custody of their son, Zander. He demanded a criminal record check on McCready, says the court documents obtained by E! News.

"McKnight believes that the mental and physical stability and condition of McCready is in controversy," McKnight's attorney, William Z. White, wrote in the filing. He further requested for financial support for their child if McKnight regains full custody of their son.

"McCready's fiancé recently, tragically and allegedly committed suicide upon the premises where McCready and Z.M resided," White states, reports E! News. "Based upon McKnight's knowledge of McCready's previous emotional and psychological health, McKnight has grave concerns for the welfare and safety of Z.M. while in McCready's sole and unsupervised care so soon after the death of her fiancé."

White further noted that McCready had refrained McKnight or his family to meet Zander at any instance. "To date," White's filing continued, "McCready has refused to allow any of McKnight's family to visit with Z.M. since her unlawful removal of Z.M. from Florida to Arkansas on or about November 30, 2011. McCready has concealed Z.M.'s condition and whereabouts from McKnight since the alleged suicide of her fiancé while upon the premises and possibly in the presence of Z.M."
