The Hershey's Company is facing a lawsuit because of its Reese's Halloween pumpkins chocolate. On the item's packaging, you can see that the chocolate should have faces.

However, the plaintiff said that when they opened the Reese's Peanut Butter Pumpkins they purchased, the chocolates didn't have the faces promoted in the packaging.

The woman said that all they received were regular-looking pieces of chocolate. Because of this, the consumer filed a lawsuit against Hershey's, alleging the company of selling deceptive products.

Hershey's Facing Lawsuit Over Reese's Halloween Pumpkins Without Faces

According to CNN's latest report, Cynthia Kelly, a Floridian resident, filed a lawsuit in federal court in Florida. The plaintiff is seeking a class-action legal action on behalf of other consumers who were allegedly misled by the pictures on Reese's Peanut Butter Pumpkins.

She specifically filed the lawsuit in Florida's Middle District court. The People reported that Kelly is seeking $5 million from the chocolate/candy company.

Kelly claimed that she wasn't alone and that other consumers who purchased Reese's Peanut Butter products were also fooled by the false and deceptive advertising of Hershey's.

The plaintiff argued that they purchased the chocolate because it was supposed to have artistic designs. Unfortunately, they found no "such carvings" in the actual chocolates.

Cynthia said that if she only knew the Reese's chocolates didn't have any carvings, she wouldn't have purchased them.

In her lawsuit, Cynthia Kelly provided photos of the Reese's chocolates she purchased. The packaging featured a jack-o'-lantern design.

However, this isn't what the product contains. This is also the same issue with Reese's White Ghost chocolate. Kelly said that she purchased the food items at an Aldi in Hillsborough County, Florida.

"Hershey's labels for the Products are materially misleading and numerous consumers have been tricked and misled by the pictures on the Products' packaging," said Kelly in her complaint. 

The Hershey's Company is the latest food firm that was sued because of false advertising.

Others already experienced this issue, such as McDonald's, Burger King, Arby's, Wendy's, and Taco Bell. As of writing, Hershey's officials haven't commented regarding the latest scandal the company faces.
