Lawyer Evan Corcoran Recuses Himself From Donald Trump's Classified Documents Probe: Sources

After winning a legal battle, prosecutors investigating the Donald Trump classified documents were able to examine his senior lawyer, Evan Corcoran.

Donald Trump's senior lawyer Evan Corcoran has reportedly recused himself from the ongoing investigation into the former president's alleged mishandling of classified documents found in his Mar-a-Lago residence, per sources.

However, according to a report from The Washington Post, sources reveal that Evan Corcoran is still representing Donald Trump in other legal proceedings, including special counsel Jack Smith's investigation into January 6, 2021, attack on the US Capitol.

When courts concluded that Evan Corcoran could not use the attorney-client privilege to withhold information about his interactions with Donald Trump, prosecutors looked into the ex-POTUS taking secret papers to his Mar-a-Lago home after leaving office won a legal battle that permitted them to examine Donald Trump's senior lawyer.

When there is proof that a client utilized the attorney's legal services to promote a crime, prosecutors identified an exception to the rule that attorneys must keep secret what their clients tell them.

DOJ To Focus on Possible Donald Trump Obstruction

The US Department of Justice is concentrating more on potential obstruction by Trump's classified documents probe of the materials seized at his Mar-a-Lago residence and if he took actions to thwart government attempts to obtain all the sensitive data or gave orders to others to do so.

A subpoena issued in May demanding that Donald Trump and his legal team turn over all materials marked with a classified designation was not complied with.

Last week, Smith's team obtained fresh information suggesting possible obstruction by Donald Trump. Smith is now attempting to decide if there is sufficient proof to urge a grand jury to indict him for obstruction of justice.

After being compelled by special counsel Jack Smith's office to testify before the grand jury without the protection of attorney-client privilege and after prosecutors charged Trump with using his lawyer to further a crime, Corcoran's departure was first reported by The Washington Post, was an expected development.

After testifying, Corcoran might continue defending Trump in the document lawsuit.

It is unclear how useful the information gave the grand jury will be to the prosecution. Evan Corcoran provided materials and gave two grand jury depositions.

Donald Trump's Legal Team Dismisses Report

The defense counsel for Evan Corcoran chose not to respond. On Saturday, Steven Cheung, a spokesperson for the Donald Trump campaign, said that the "unnamed sources" do not have any knowledge of the real situation and are promoting "disinformation," CNN reported.

The prosecution wanted to question Evan Corcoran about his direct interactions with Donald Trump concerning a May 2022 subpoena for all Trump classified documents, the subsequent hunt for classified records, and the conversations they had after the Trump Organization received a separate subpoena for surveillance footage of the club, per Kake.

The allegations that Donald Trump purposely handled sensitive materials improperly during and after his administration are at the core of the Trump classified documents inquiry. The Republican leader's storage of sensitive papers at his Mar-a-Lago estate in Florida and concealment of those records from federal agents are among the conduct that prosecutors are looking at.

Donald Trump may face charges of obstructing the administration of justice, according to the Justice Department.
