A Texas man exonerated for a 2010 stabbing is now accused of killing another man in a road rage incident.

  • The suspect was previously arrested for a stabbing death, for which he was ultimately found innocent
  • Grant was officially exonerated in 2021

Police say a man declared exonerated of a fatal stabbing conviction and seven years in prison in 2021 has been charged with murder in the shooting of a fellow motorist.

Thursday night, Houston police said Lydell Grant, 46, is suspected of killing Edwin Arevalo, 33, following a minor traffic collision. According to police, Grant exited his vehicle, shot Arevalo, and fled.

Lydell Grant's Case

Grant was arrested on Friday after a warrant was issued for his capture, according to police. On Sunday, he remained in prison on a $1 million bond. ABC reported that the attorney for Grant listed in the court documents for this case could not be reached promptly on Sunday.

Grant was convicted in 2012 of stabbing 28-year-old Aaron Scheerhoorn outside a Houston tavern in 2010. At Grant's trial, six witnesses to the assault testified against him.

The Texas Court of Criminal Appeals declared Grant innocent in May 2021 after a new analysis of DNA discovered on the victim's nails indicated Grant's innocence. In 2019, after serving seven years of a life sentence, he was released on parole pending the appeals court's decision.

Jermarico Carter was apprehended in 2019 for Scheerhoorn's murder. Carter, who was located in Atlanta, admitted to the murder. In 2022, he pleaded guilty to murder and was sentenced to prison.

The Innocence Project of Texas, which had labored to exonerate Grant, stated that it could not comment on the specifics of the incident because an investigation is ongoing. The group expressed its "thoughts and sympathies to the victim's family."

"The highest responsibility of a prosecutor is to ensure that justice is done, and ensuring that the correct individual is charged a baseline responsibility," said Harris County District Attorney Kim Ogg.

Footage Shows Texas Man Shoots Motorist

Grant's counsel, Mike Ware, also the Innocence Project executive director, remarked, "We are relieved that Lydell's wrongful conviction has reached this significant milestone."

Carter pled guilty to the homicide of Scheerhorn last year, while the Texas Court of Criminal Appeals declared Grant innocent in May 2021.

On Friday, Grant was apprehended after authorities say surveillance footage from the crash near the intersection of Hiram Clarke Road and Brentwood Park Drive helped them identify him as the shooter.

His defense now contends that Grant has been operating his own house-cleaning business for six months and supporting his mother. Per Daily Mail, they argued in court that the last allegation on his criminal record occurred in 2009.

The Innocence Project of Texas issued the following statement to ABC 13: "We are devastated by the news of this tragic event, and our thoughts and condolences are with the victim's family."

"As this investigation is ongoing, we cannot comment on the specifics of this incident," the spokesperson explained. However, he stated, "We stand by Mr. Grant's previous exoneration by the Texas Court of Criminal Appeals."
