Apple vs. Samsung Patent War: iPhone 5, Galaxy Note 10.1, Galaxy S III Added to the Lawsuit

The patent war between the smartphone giants is getting uglier each day. The latest news is that a judge has allowed Apple and Samsung to include some of their recent products in the ongoing lawsuit.

U.S. magistrate judge Paul Grewal granted a motion to include Apple's iPhone 5 to the existing complaint by its rival while allowing an Apple request to add Samsung Galaxy Note 10.1, U.S. Galaxy S III, and Android 4.1 Jelly Bean to the case.

Android 4.1 was included in the list in conjunction with the Galaxy Nexus smartphone. The judge concluded that adding these flagship products to the lawsuit does not significantly alter the case.

The new addition of Samsung devices shows an aggressive Apple approach which has so far sued 19 Samsung's devices of infringing claims from eight of its patents. The case is scheduled to go to trial in March 2014.

The judge warned Apple on the possibility that that some of its latest tablets may also be allowed to be added if Samsung requests their inclusion.

"Given the early stage of this litigation and the reasoning of this order, the court notes that Apple should think twice before opposing similar amendments reflecting other newly-released products - e.g. the iPad 4 and iPad mini - that Samsung may propose in the near future," judge wrote in his order, reports IDG News Service.

Any amended contentions shall be served no later than Nov. 23, he added.

In an earlier judgment, a Northern California jury ordered Samsung to pay Apple $1.05 billion for infringing several of its patents in Samsung smartphones and tablets.
