A California family can't seem to get rid of their nightmare live-in nanny - even after firing her.

Marcela and Ralph Bracamonte, the parents of three children, said they have tried and tried to get their live-in nanny to leave after firing her three weeks ago, ABC News reported. The couple has even sought out the aid of law enforcement and presented the nanny, Diane Stretton, 64, with legal papers, but she still won't budge.

The Bracanonte's found Stretton on Craigslist in March and agreed to let her live in their Upland, California, home free of charge in exchange for her taking care of their children, ages 11, 4 and 1.

Marcella Bracamonte said the first two months were great. "And then she wouldn't do anything," she told CBS Los Angeles. "She would stay in her room 90 percent of the day. I really did try to work with her. She would just sit in her room all day. So I told her, you either have to perform or you gotta leave."

Stretton, who apparently has been involved in 36 lawsuits, told the parents she has chronic obstructive pulmonary disease that makes her unable to perform her duties, ABC News reported.

The couple presented the nanny with a "last chance letter" on June 6 stating the terms of her employment. Stretton refused to sign but told the Bracamontes she would be out within 30 days. But when the couple presented her with the 30-day notice in writing, she again refused to sign, saying it was not "legal."

So Marcella contacted the police to get rid of the woman her husband calls a nightmare nanny.

"They told me it was now a civil matter," Marcella told CBS Los Angeles. "And I have to legally [evict] her. So this lady is welcome inside my house, anytime she wants, to eat my food anytime she wants and harass me basically. I'm now a victim in my own home and it's completely legal."

Marcella served Stratton with legal papers, only to have a judge later tell her she filled them out incorrectly.

The couple finally served the nanny with the proper eviction papers on Wednesday. Stretton has three days to respond, CBS Los Angeles reported.

So far, Stretton has provided no explanation for why she refuses to leave.
