
OpenAI is under investigation by a coalition of state attorneys general, who have requested records from the company on a range of topics related to ChatGPT. A spokesperson for OpenAI said it is cooperating with the probe.
According to reports, the coalition includes attorneys general from dozens of states. New York's attorney general served OpenAI with a subpoena on Friday seeking records on the company's advertising, user engagement and retention, consumer and health data, protections for minors and older users, its AI models, and internal company policies.
The investigation comes as OpenAI faces separate legal challenges over ChatGPT. Florida sued the company and Chief Executive Sam Altman on June 1, alleging it had misrepresented the chatbot's safety; the complaint sought damages and restrictions on ChatGPT. On June 11, a Canadian mother filed a lawsuit in U.S. court alleging that ChatGPT contributed to her daughter's death.
OpenAI has expanded ChatGPT rapidly, reporting hundreds of millions of users and millions of business customers, and is preparing for a potential public offering after confidentially submitting a draft registration to the Securities and Exchange Commission this month. The company has also been building out an advertising business and new enterprise features.
The state inquiry adds to growing regulatory scrutiny of leading AI companies in the United States over data practices, consumer protection, and the safety of AI products. OpenAI has said it cooperates with regulators and works to improve safeguards on its products.
