'Attractive Convict' Whose Mugshot Went Viral Sues Website that First Publicized Her Image

A woman whose mugshot went viral is suing the website that first publicized the image.

28-year-old Meagan Simmons' booking photo became the canvas for hundreds of Internet jokes, memes, and responses.

Dubbed the "Attractive Convict," Simmons, who is a mother to four children, said her DUI picture was "terrible," during an interview with the Daily Mail.

"I don't think it's that good a picture," she told the gossip site. "There are other ones I would prefer."

The Florida native has officially filed suit against InstantCheckmate.com, on grounds that the website used her photo without gaining proper clearance.

In her suit, Simmons' legal representatives alleged that the photo's wide circulation disturbed her peace of mind and was a breach of privacy.

Attorney Matthew Crist, who is representing the Zephyrhills resident, compared Simmons' situation to Tom Cruise's - the actor's photo was used in a Colgate ad without his permission, the Daily Mail reported.

"At the end of the day, this is actually about intellectual property. If someone is going to use your image, they need to pay you for it," Crist said. "The legal issue is, it's your face, and your name. You own it. You can use it, you control it and when someone misappropriates it - that's when you're violating Florida law."

The advertisement for the site originally read, "Sometimes the cute ones aren't that innocent," below Simmons' mugshot.

Simmons told the Daily Mail that she's gained thousands more followers on Instagram, received dozens of invitations for dates and professions of love.

Online memes depicted Simmons with such captions as "GUILTY - of taking my breath away," and "Arrested for breaking and entering - YOUR HEART."
