Topless Pictures Of Woman On Empire State Building Leads To Lawsuit (PHOTO)

The Empire State Building management is suing a fashion photographer for taking pictures of a topless woman on the famed skyscraper's observation deck.

Allen Henson used his phone to snap pictures of a topless model on the 86th floor observatory in August 2013, Reuters reported. The images then went viral after Henson, 30, posted them on social media.

But the photos were not a hit with Empire State officials, who could not believe that someone shot naked pictures on a landmark attraction crowded with families. The iconic building's management filed a lawsuit against Henson on Monday, seeking over $1.1 million in damages

The lawsuit claims Henson took the photos "for his own commercial purpose" and desecrated the Empire State's "reputation as a safe and secure family friendly tourist attraction," Reuters reported.

"Breasts are dangerous?" Henson, who has been photographing models for the last three years, told the New York Daily News. "I'll take the publicity but it's hard to take this seriously."

Henson has also previously taken pictures of topless women in Central Park and the Peninsula Hotel in Manhattan, Reuters reported. Henson began taking the topless photos when he found out about a May 2013 memorandum preventing NYPD from arresting women who took their shirts off in public.

"I said, 'This is legal. That's incredible. Let's see what that means in action,'" Henson told the Daily News.

"We were doing a social experiment," Henson told Reuters.

Management's lawsuit also said they were "never notified about the plan for the shoot and [Henson] did not seek or obtain permission for the topless photo shoot from ESB at any time," the Australian Broadcasting Corporation, ABC, reported.

"At the time that [Henson] and the model entered the observatory, it was crowded with visitors, including children."

But Henson said that the building's security never did anything when he was taking the pictures.

"Nobody seemed to mind. The girl has a wonderful pair of breasts but to be honest if you've seen the view up there it's pretty breathtaking and I don't think anybody noticed," Henson said, ABC reported.
