Lindsay Lohan was charged with assault after she punched a woman while partying at NYC hotspot Avenue early Thursday morning.
Lohan in trouble again after she was charged for assault under alcohol influence as witness reports but her lawyer says she was not intoxicated. The troubled starlet had run-in with law enforcement many times and this adds to her charge-sheet. Earlier she was charged with three crimes in Santa Monica, California and also for providing false information to a police officer and rash driving too.
The witness at the club reported Lohan was heavily drinking. "Lindsay was drinking a ton, not trying to hide it," an eyewitness told Us Weekly. "She was drinking Grey Goose and also champagne. The vodka bottle was right in front of her."
The witness explained to Us Weekly how it all started, "At one point, Lindsay moved up to VIP and was trying to get the woman to move her coat and purse in order to make room for her, but the woman was ignoring Lindsay. Lindsay started yelling at her and the woman told her to stop. Lindsay eventually huffed back to her table, furious."
"Lindsay was standing on the couch at her table, which put her even with the woman seated in VIP above her. She turned around and clocked her in the face," the witness continued.
As the video of the incident is being pulled, this will give the inside of the story. In the meantime, her attorney Mark Heller Spoke with E! News, assuring Lohan was not under the influence of alcohol. "I can tell you when I was with her this morning, she was in great condition," Heller told E! News. "She was certainly not intoxicated, certainly not under the influence of drugs. She was clear [and] lucid, her eyes were clear. No alcohol involvement whatsoever on this occasion."
"We are going to be working very earnestly to establish that no charges should even be lodged," he said in Lohan's defense in a report by Us Weekly. The actress is due to go through formal third-degree assault charges at an arraignment on Jan. 7. "[The police] have already made arrangements to get the video from the...club, which hopefully will reveal some exonerating information. After that, they could just walk away from the case and decline to even prosecute."
