A New York grand jury handed down their decision in the gruesome and unfortunate case of Kevin Ward Jr.'s death and the question of Tony Stewart's culpability.

The grand jury in Ontario County, New York determined that Tony Stewart will not face criminal charges.

Stewart and his family will no doubt breathe a sigh of relief at the news, and attempt to put the situation behind them as quickly and neatly as possible.

Ward Jr. was struck and killed August 9th during an Empire Super Sprints Series race, after he left his vehicle under caution to confront Stewart.

District Attorney Michael Tantillo announced earlier Wednesday that the jury had completed its investigation only a day after grand jury testimony began, and their determination would be handed down today.

Chuck Hebing, who was driving in the Canandaigua, New York race along with Ward Jr. and Stewart, confirmed earlier to the Rochester Democrat and Chronicle that he had been called to testify.

During the race, Hebing's car steered around Ward Jr. just before Stewart's car clipped him.

Stewart released a statement through Stewart-Haas Racing after the announcement that the case would go to the Grand Jury.

"I respect the time and effort spent by both the Ontario County District Attorney and the Sheriff's Office in investigating this tragic accident. I look forward to this process being completed, and I will continue to provide my full cooperation."

Stewart has competed in four NASCAR events since Ward Jr.'s death.
