UPDATE: The team has made the move official.

The Niners have released a statement announcing the move. Via ESPN's Adam Schefter: "This organization has tried very hard to help Aldon fight his issues. Although he is no longer a member of this team, our support and concern for him will continue." 

Per Trotter, via Mike Loyko of NEPatriotsDraft.com, the Niners released Smith because during his meeting with GM Trent Baalke he refused to take responsibility for his actions.

NFL linebacker Aldon Smith, arrested Thursday night for the third time since 2012, is set to be released by the San Francisco 49ers, according to Jim Trotter of ESPN.

Smith was arrested on suspicion of DUI, hit and run and vandalism, it was announced early Friday. After posting bail, Smith spoke briefly with reporters, stating that his arrest was not for a DUI and vowing that "justice will be served."

This latest run in with the law marked Smith's fifth arrest total.
