Josh Duggar: Jail Time Possible Following Danica Dillon Lawsuit, Family Is 'Terrified,' Sources Say

Porn star Danica Dillon claimed that she had two sexual encounters with troubled reality star Josh Duggar back in August and eventually filed a lawsuit last month, claiming that he "assaulted her to the point of causing her physical and emotional injuries," as HNGN previously reported. New reports are now stating that this $500,000 civil lawsuit against the former "19 Kids and Counting" star, who is currently in a long-term rehab treatment center following his cheating scandal and porn addiction revelation this past summer, could lead to possible jail time.

If the lawsuit filed against Duggar leads to a criminal investigation into his actions, a prison stint could be the ultimate result, according to In Touch Weekly. If this were to happen, he would have to answer questions under oath. He could also face prostitution charges, since he did pay Dillon $1,500 to have sex after meeting her at a strip club.

"Josh and his parents Jim Bob and Michelle are terrified by Danica's lawsuit and the possibility that he could get locked up," a source close to the family told the magazine. "[Jim Bob] doesn't want this case becoming a criminal matter. He knows Josh would never be the same if he went inside. They're afraid Josh going to jail would leave an indelible stain on the family name and that they, too, would be punished for years because of what he did."

"Anything that he says in a deposition for the civil case has the potential to be used against him and police could open a criminal investigation," said Philadelphia criminal defense attorney Lloyd Long III, who isn't involved in the case whatsoever. Duggar could be charged with anything from misdemeanor simple assault, which carries a maximum sentence of one to two years, to a felony aggravated assault, which carries a 10-year to 20-year maximum sentence.

His wife Anna just recently visited him in the faith-based rehab center in Rockford, Ill., for Christmas despite the difficult year, a source told People. Earlier in the year, Duggar was also accused of inappropriately touching five minor girls, two of which were his sisters Jill and Jessa, when he was a teenager, but his wife didn't let the scandals stop her from spending time with her husband during the holidays.

Anna flew to the center, and the family did their best to have a good holiday without their son. "Everyone just had fun and seemed to be high spirits, including Anna," the source explained.
