Ebony Wilkerson, the pregnant mom accused of trying to murder her three children by driving the family's packed minivan into the Florida surf,  was ruled not guilty by reason of insanity. 

Wilkerson's three counts of second-degree attempted murder were dropped against her when her defense team agreed to a plea deal with prosecutors, reported NBC News. By agreeing to the plea deal the defendant waived her right to a jury by trial.

A judge came to this agreement after reviewing Wilkerson's medical records. 

A defense psychologist said Wilkerson suffered a psychotic break at the time of the crime. Just days before Wilkerson attempted to drive her family into the surf she was raped in a hotel room by her husband, NBC News reported. 

Wilkerson, who is a resident of South Carolina, fled to Florida after the rape with her children. Her sister saw Wilkerson having a break down and alerted authorities. 

Wilkerson was 28-weeks pregnant when was arrested at the scene in Daytona, Florida. She gave birth to her son while in jail, reported NBC News. 

The mother of four was released on bail under the condition that she has no contact with her children. 

Although she was ruled not guilty, the judge must still decide whether she should be hospitalized or if she can get community release with oversight by the court.
