An alleged child killer from Texas was freed from jail after 18 months because the county's medical examiner temporarily misplaced crucial evidence that would have convicted the killer. 

"Based on the timeline the medical examiner's office was giving us, we really had nothing else we could do other than dismiss the charges," Assistant District Attorney Adam Poole told KHOU-TV.

Taylor Moore, 4, was critically injured during a fight between her father, Kevin Moore, and his girlfriend Laura Kolb. 

The girl's father left the apartment to cool down from their argument, but Kolb decided to take her anger out on Taylor. Kolb allegedly shoved Taylor on the floor before throwing the young girl on a bed, reports KHOU-TV.

Taylor died on March 23, 2013. Her autopsy proved that her injuries from Kolb are what killed her. 

The Galveston County Medical Examiner's Office had crucial pieces of incriminating evidence that were going to be used against Kolb in court Monday, but the office misplaced the evidence, reports KHOU-TV. 

Since the evidence was not present, Kolb was released from jail - where she was being held for 18 months - instead of being tried in front of a judge. 

After the alleged murderer was released, the office found the evidence. 

Poole told KHOU-TV that he hopes to reopen the case by the end of the week with the evidence.
