An Arizona mother sentenced to death for the murder of her 4-year-old son in 1990 is expected to be released in a few weeks according to Radar Online. 

Debra Jean Milke was convicted of conspiracy to commit murder, child abuse, and kidnapping. Judge Alex Kozinski overturned the verdict on the grounds that the lead investigator, Detective Armando Saldate, falsified information and the evidence used to convict the mother.

According to Radar Online, in a 60-page verdict, the judge said that he found the "unorthodox interrogation methods" of the lead detective to be 'troubling'" and that Saldate has a "long history of trampling the rights of suspects."

It has been reported that at the time of the trial nor the jury or the defense team was notified that the now retired detective's methods and suspect handling were questioned prior to the case. Judge Kozinski accuses the detective of not conducting the interview with Milke with any witnesses present, did not read her her Miranda Rights, and did not get the Miranda Rights waiver signed by Milke.

Saldate did not comment on the accusations but has urged the judge to overturn the new verdict but was denied. 

In the case of the murder of Milke's son, Christopher, Milke claimed she gave her son to a friend who planned on taking the child to a local mall for the holidays. The friend in question and now convicted murderer, James Styers, abandoned the plans and met with accomplice Roger Scott and shot the 4-year-old in the head. Prosecutors presented the case as a mother who wanted to cash in on her child's $5,000 insurance policy. 

Milke is still behind bars but is expected to be released in a few weeks if prosecutors decided no to retry her case.
