New York City police officers from the same Staten Island precinct involved in the death of Eric Garner are being accused of nother accidental death, the New York Daily News reported in an exclusive.

A lawsuit filed this week claims three cops at the 120th Precinct assaulted 52-year-old Irving Mizell during his arrested on March 7, 2013. As Mizell was being booked he complained of having trouble breathing, but the police did not seek medical attention, according to the lawsuit.

Mizell collapsed at the precinct that evening and was taken to Richmond University Medical Center where he was pronounced dead.  A medical examiner ruled his death an accident stemming from a heart attack and acute intoxication caused by the effects of alcohol and Valium, according to the newspaper.

The victim's family says the actions of the arresting officers, Todd Craven, Megan Carroll and Earl Javellana, contributed to his death.

Mizell was arrested outside his girlfriend's apartment door for violating an order of protection she filed against him. Police took Mizell and "viciously beat and assaulted him while dragging him down seven flights of stairs," according to the lawsuit obtained by the newspaper.

An autopsy found evidence of multiple blunt injuries to Mizell's head, his torso and extremities as well as a bruised lung, according to Thomas Giuffra, the family's lawyer.

"To say his death was an 'accident' is absurd," Giuffra told the Daily News. "It's shocking to me that this could happen in New York City in the 21st century."

A panel that investigates police complaints, the Civilian Complaint Review Board, accused Officers Carroll and Javellana last week of failure to seek medical treatment for the victim. The board also charged Officer Craven with using excessive force during Mizell's arrest.

The city's Law Department said it will review the lawsuit. All three officers are still on duty, the Daily News reported.

The victim's brother, George Mizell, told the newspaper his brother had a drinking problem but that he was "absolutely harmless."

In the meantime, Internal Affairs is investigating the 120th Precinct cops involved in the death of Eric Garner, who died on July 17 after an officer allegedly placed him in a chokehold as other officers forced him to the ground.
