Rep. Matt Gaetz attacked special counsel Robert Hur at a House Judiciary Committee hearing on Tuesday morning, questioning his report on President Joe Biden's handling of classified documents.

Hur's report concluded that Biden should not face criminal charges.

Gaetz accused Hur of a double standard in Biden's case claiming he should have faced charges.

He says that Biden lied about sharing classified information and shared video of an exchange in which is says Hur admitted that Biden lied.

The Florida Republican claimed Hur went easy on Biden under a so-called "senile cooperator theory."

The now former special counsel stood by his assessment of the president's memory as "accurate and fair," in prepared testimony to be delivered to Congress.

Special counsel Jack Smith charged Trump in June for mishandling top secret documents at his Mar Largo estate in Florida.

The indictment alleges that Trump repeatedly enlisted aides and lawyers to help him hide records demanded by investigators.

Biden has not been charged.

Gaetz has faced his own Justice Department investigation. Gaetz was accused of violating sex trafficking laws. The department declined to bring any charges in the case.
