A mom is suing Southwest Airlines for "blatant racism" after being suspected of trafficking her 10-year-old biracial daughter.

A white mother, Mary MacCarthy, has taken legal action against Southwest Airlines by filing a racial discrimination lawsuit in federal court.

The lawsuit stems from an incident in October 2021 when MacCarthy and her 10-year-old multiracial daughter were accused of potential human trafficking by a Southwest flight attendant, according to CBS News.

Mom Sues Southwest Airlines

The distressing incident occurred when MacCarthy and her daughter were traveling from Los Angeles to Denver to attend her brother's funeral. Upon landing in Denver, they were confronted by police officers who were called in due to the flight attendant's suspicion about their relationship.

The flight attendant's baseless suspicion was allegedly rooted in a racist assumption about a mixed-race family, according to the lawsuit filed in the District Court of Colorado. MacCarthy's suit argues that there was no legitimate reason for the flight attendant to believe that she was trafficking her daughter.

The crux of the accusation against Southwest Airlines is that the attendant's call to authorities was solely based on the erroneous belief that MacCarthy's biracial child could not possibly be her own. As MacCarthy and her daughter walked down the jet bridge after the plane landed, they were subjected to questioning by the police.

The incident left her daughter in tears and caused both of them extreme emotional distress. Eventually, the officers allowed them to leave, acknowledging that there was no substance to the accusation. The police report regarding the incident was ultimately marked as "unfounded," leading to no further action.

In defense against the accusations, the flight attendant had stated in the police report that she was concerned because MacCarthy and her daughter did not talk during the flight, deeming it unusual behavior.

Additionally, she claimed that the mother did not allow the child to communicate with the flight crew. MacCarthy refuted these claims, explaining that her daughter had been listening to an audiobook for most of the flight, and they had indeed engaged in conversation throughout the trip, Washington Examiner reported.

Racial Discrimination Lawsuit Raises Questions About Policies and Training

It remains to be seen how the airline will address the racial discrimination lawsuit and its potential impact on their policies and training procedures. Following the traumatizing ordeal, MacCarthy revealed in subsequent interviews with the press that she now carries her daughter's birth certificate with her at all times, anticipating the possibility of being questioned about her relationship with her child.

The incident has left a lasting impact on MacCarthy and her family, highlighting the broader issue of racial profiling and the need for increased awareness and sensitivity among airline staff and society as a whole. The case involving Mary MacCarthy and Southwest Airlines serves as a poignant reminder of the importance of combating racial discrimination and bias in all aspects of life, including air travel.

As the legal proceedings unfold, it remains to be seen how the airline industry will respond to such incidents, taking steps to ensure the fair treatment of all passengers regardless of their race, ethnicity, or family composition, as per to New York Post.
