Apple is expecting at least $380 million as payment for the patent damages caused by Samsung. However, Samsung believes that they owe $52 million only.

In August 2012, the South Korean company Samsung was found at fault of infringing six Apple patents and was forced to compensate the American company $1 billion.

However, in March 2013, the amount was revisited by Judge Lucy Koh and implied the previous jury inaccurately computed the compensation for damages and it would need to be reassessed at a new hearing scheduled.

The two smartphone giant companies returned to court on Tuesday, to discuss the most accurate amount that Apple needs to receive from the Korean company.

According to The Washington Post, Apple attorney Harold McIlhenny, told the jury, “Apple lost sales because Samsung was selling infringing products.” He said that if Samsung’s sales of units with infringed patents are totaled, it will amount to $380 million.

McIlhenny added, “In a fair fight, in a fair competition, the money they got would have and should have gone to Apple.”

Bill Price, Samsung’s attorney, opposed McIlhenny statements in his opening speech saying that consumers opted for Samsung devices over Apple iDevices, not because of the “infringed features”, but because Samsung devices runs with Google’s Android operating system. Price told the jury that his client just owes Apple $52 million, not $380 million.

Ptice said, “Apple is simply asking for much more money than it’s entitled to.”

Samsung’s lawyer had admitted that Samsung was guilty of infringing Apple’s features, but downplayed the importance of the technology in devices that are created with a lot of patents each.

“This is a case not where we’re disputing that the 13 phones contain some elements of Apple’s property,” Price said. “That doesn’t mean Apple gets to come in here and ask for a windfall ... for more than it is entitled.”

The court trial is likely to last until mid next week.
