Virginia's lethal drug issues shouldn't slow down their execution scheduled for next week, as the state has purchased 150 milligrams of pentobarbital from Texas, according to the Raw Story. The Texas Department of Criminal Justice confirmed the disclosure Friday after it was revealed in court documents of an Oklahoma death penalty case.

The Texas Department of Criminal Justice has been compounding their own pentobarbital, a drug used in animal euthanasia, which has department of corrections across the country scrambling to obtain, according to The Christian Science Monitor reported.

Documents obtained this week show that Texas is manufacturing their own pentobarbital, a drug which has been impossible to obtain due to restrictions manufacturers have placed upon the drug used for lethal injections.

Attorneys for Oklahoma death row inmate Richard Fairchild want Oklahoma to obtain the pentobarbital from Texas as an alternative to Oklahoma's current practice of using midazolam, a drug which has been in the spotlight lately when used for a series of botched executions.

The conundrum comes on whether or not this practice is legal.

Texas prisons spokesman Jason Clark confirmed that the Texas Department of Criminal Justice did indeed give Virginia three vials of pentobarbital, even though the state has no license to manufacture its own drugs, according to FOX News.
