A few weeks after Lamar Odom was found unconscious in a Nevada brothel due to a cocaine overdose, officials revealed that there was a very high chance that he could be prosecuted for drug possession, and a Nye County Sherriff recommended that this happen, as HNGN previously reported. Since the former NBA star still remains in the hospital barely able to speak or walk, he may legally catch a break.

Law enforcements have said that the Nye County D.A. in Nevada is backing off the statements previously made by the Sheriff, according to TMZ. The D.A. revealed that his medical condition and mental state will now be considered during their decision on whether or not to charge him. He also may not be legally competent to stand trial.

While this seems extremely lucky, turns out it's pretty unlikely for charges to happen under these circumstances. TMZ did some background checks and couldn't find any cases in Nye County where someone was prosecuted for cocaine possession after ending up in the hospital with severe damage.

At this point in his recovery, it would be hard for Odom to even understand how or why he was being prosecuted. While on "The Ellen DeGeneres Show" earlier this month, his wife Khloe Kardashian explained to the host that he is unaware of why he is even in the hospital. 

"We tell him he had a brain injury," she explained. "I can't tell him how that brain injury was caused because it will set him back. He's really confused a lot, so we have to remind him. Every day is different...He is learning how to walk again and feed himself again, put sentences together. He is off of all machines that help his organs but still he has a long way to go...It's a long, long road ahead."

"Lamar has made some progress, but his cognitive impairment is making life very challenging," an insider told People last week. "Lamar won't likely leave the hospital for a long time. And when he does, he will need full time care. He can't take care of himself. He has serious long term and lasting issues. His life will never be the same as it once was."
