Rush Limbaugh seems to think U.S. Attorney General Eric Holder may be stepping down to make it easier for President Barack Obama to nominate him to the Supreme Court if a space opens up, The Daily Caller reported on Thursday.

"There may be a Supreme Court vacancy - and I can see Barack Obama nominating Eric Holder to fill it," Limbaugh said on his radio show Thursday.

There are no vacancies in the Supreme Court right now, but four of the nine justices are over 70. While it is unlikely one of the conservative justices would resign while Obama is president, it isn't hard in theory to imagine liberal justice Ruth Bader Ginsberg, 81, vacating her seat so a liberal president could nominate her replacement. But Ginsberg just struck down the possibility in an interview with Elle Magazine.

The only other liberal justice who is of an elevated age is Stephen Breyer, 76, and there has been nothing to suggest that he's considering stepping down. Anthony Kennedy, who is considered a swing vote as of late even though he was appointed by Ronald Reagan, is 78, but there has also been no indication he is considering leaving the bench anytime soon, either.

But even if a vacancy opened up, it's likely a figure as controversial with Republicans as Eric Holder would face intense backlash if confirmed, especially if Republicans win the Senate in November.
