A medical official at a Bronx nursing home was caught sexually assaulting a 64-year-old mute patient while she was sleeping on Tuesday.

New York City police told NBC that 42-year-old supervising nurse Nanic Aidasani was arrested and charged with rape after he was found on top of the patient in her room. The 64-year-old resident, whose identity has not yet been released, was reportedly sleeping when Aidasani attacked her.

According to NBC, it's still unknown whether Aidasani has a lawyer at this time. He didn't answer questions from a crowd of reporters waiting outside an N.Y. police station on Tuesday.

The victim's daughter, who requested to be called only by her first name Loida, said she was "heartbroken" after hearing about the attack on her mother.

"I've cried, I don't have tears anymore," Loida stated.

Loida said she brought her mother to New York Presbyterian Hospital for a rape kit test immediately after she heard of the attack. According to NBC, an eyewitness first informed Loida of the event.

Since Loida's mother is unable to communicate, however, doctors were forced to turn the victim away. Medical officials told Loida they could only perform the examination with a court's authorization.

"This is very important, this is key evidence," Loida told reporters. "My mother is unable to speak, so by doing this exam, you're going to have the physical evidence of what happened."

The victim's son, who also asked to be identified by his first name Alejandro, stressed the time constraint and importance of the rape kit examination.

"We have 72 hours for them to perform this kit," Alejandro told NBC. "Right now, we're running out of time."

It's still unclear how police were first alerted of the attack. Neither the hospital nor the Bronx nursing home have commented on the alleged rape.

Loida and Alejandro stated they are the legal guardians of their mother.
