Elon Musk Twitter Deal: Tesla Boss Scores Rare Win in Battle to Cancel $44 Billion Purchase

Twitter is now required to provide Elon Musk the documents from its former executive who could determine how many bot and spam accounts in the social media platform.

A court order issued on Monday requires Twitter Inc (TWTR.N) to provide Elon Musk with documents from an ex-Twitter executive who Musk claimed was crucial in determining the number of fake user accounts on the social media network.

In the court battle over whether tech billionaire Musk, the CEO of Tesla Inc. (TSLA.O), must pursue his $44 billion takeover of the social media business, bot and spam accounts on Twitter have emerged as a critical concern, as per a report from Reuters.

Chancellor Kathaleen McCormick of the Delaware Court of Chancery ordered Twitter to gather, examine, and submit records from former General Manager of Consumer Products Kayvon Beykpour.

Elon Musk, the world's wealthiest man, his lawyers, and Twitter have not yet responded to the request for comment as of this reporting.

Elon Musk's Twitter Bot Concerns

Kayvon Beykpour was one of the executives "most intimately involved with" identifying the number of spam accounts, according to Musk's court documents. Beykpour left Twitter after the social media business agreed in April to be acquired by Elon Musk.

An inquiry for comment on Elon Musk twitter situation was not immediately answered by Beykpour.

Musk sought access to 21 additional individuals who had access to pertinent material, but McCormick stated in her decision on Monday that she was rejecting this request.

Last week, Musk's legal team sent a letter to McCormick pleading with her to order Twitter to provide the identities of its employees so that they might be interrogated.

Twitter has refuted Musk's allegations that it misrepresented the number of actual active users on its site when he made them earlier this month. Euronews reported that the social media company claims the multibillionaire broke his promise to buy it, and it wants McCormick to order him to close the sale at $54.20 per share.

Kayvon Beykpour joined Twitter in 2018 as Jack Dorsey's deputy. He and a few other executives were let go in May by Dorsey's successor, Parag Agrawal. Beykpour claimed on Twitter that he did not decide to leave the social media company, according to a report from Insider.

Beykpour probably has knowledge and documentation concerning the bot analysis Musk is searching for given his position as head of consumer product at Twitter for several years.

According to a person with knowledge of the issue, Musk's lawyers also requested information from other workers, including mid-executive level and lower-level staff.

A Rare Victory for Musk

Musk now has a rare victory in the case Twitter filed last month to pressure the billionaire to follow through on his deal to buy the platform for $44 billion as per Judge McCormick's ruling.

Judge McCormick sided with Twitter in the initial hearing between the two parties, ruling that its case against Musk may go to trial by October.

For his part, Musk appears to have toned down his aggressiveness recently on Twitter. In almost two weeks, he hasn't tweeted about the business or the Elon Musk twitter case. He claimed that he sold about $7 billion worth of Tesla shares last week to be prepared if he has finally instructed to purchase Twitter.
